Terms and Conditions
1. Introduction
This document establishes the terms and conditions for using the mihaiteodorolteanu.ro website and the conditions for acquiring the artworks presented on this platform. The site is administered and operated by the Cupola ProArte Association, a Romanian private legal entity of a non-profit nature (non-profit organization), with its registered office in Timișoara, 4 Poet Andrei Mureșanu Street, Apt. 3-4, Timiș County, Postal Code 300159, established pursuant to Civil Ruling No. 7483/03.03.2026 and fiscally registered with the Unique Registration Code (CUI): 54463756. By browsing this site and placing an order, the purchaser implicitly, fully, and unconditionally accepts these Terms and Conditions.
2. Order Status and Invoicing
All artworks exhibited on the site are original creations signed by the master Mihai Teodor Olteanu. The proceeds from the acquisition of the works represent funds directed entirely to the Cupola ProArte Association to support its mission, finance cultural projects, and promote contemporary art. For each successfully completed order, the Association will issue a fiscal invoice in accordance with current Romanian legislation.
3. Copyright and Intellectual Property
The acquisition of an artwork transfers to the buyer exclusively the physical ownership right over the respective canvas. Copyrights and all reproduction rights remain entirely and permanently the exclusive property of the artist Mihai Teodor Olteanu. It is strictly forbidden to reproduce, copy, photograph for commercial purposes, publicly distribute, or use images of the works for any commercial or editorial purposes without the prior, express written consent of the artist or his legal representatives.
4. Authenticity and Visual Presentation
Each shipped piece is a unique original work of art. We make constant efforts and use professional photography techniques so that the images on the site faithfully render the true colors, volume, and textures of the impasto layers. However, due to differing technical settings of mobile device screens and monitors, slight variations in shade may exist between the digital image and the physical work. These variations are entirely normal within the digital art market and do not constitute a defect.
5. Shipping and Logistics Policy
Original artworks require a rigorous multi-layer securing and packaging protocol adapted to their dimensions to guarantee they reach the collector safely.
- Dispatch timeframe: Orders are processed, verified, packaged, and handed over to specialized courier services within 3-5 business days from the confirmation of payment receipt in the Association's account.
- Secured transport: Delivery is carried out nationally and internationally through partner rapid courier operators under a fragile handling regime.
- Transfer of risks: The risk of loss or damage is legally transferred to the buyer at the moment they or a person designated by them takes physical possession of the package. We strongly recommend checking the visual integrity of the packaging in the presence of the courier.
6. Return Policy (Right of Withdrawal)
We wish for every collector to fully resonate with the energy and vibration of the acquired work. In accordance with legislation regarding consumer protection in distance contracts (GEO 34/2014), you have the legal right to return the work within 14 calendar days of receiving it, without the obligation to justify the decision.
Mandatory conditions for accepting the return:
- Official notification: The firm intention to return must be transmitted in writing, explicitly, to the email address: [email protected] before the expiration of the 14-calendar-day term.
- Logistical costs: Direct transport costs related to the return of the artwork are borne entirely by the buyer. Considering the extreme value and fragility of the goods, the return must be carried out exclusively through a rapid courier service insured for the real value of the work.
- Integrity of the work: The work must be returned in its initial physical state, intact, without any trace of damage, scratching, impact, or subsequent intervention, accompanied by the original Certificate of Authenticity and in the complete original packaging.
- Refund of funds: The acquisition value will be reimbursed exclusively via bank transfer to the IBAN account indicated by the buyer, within a maximum of 14 days from the physical receipt in the studio and expert verification of the returned work's integrity.
Special exceptions from return: Artworks executed on the basis of customized orders or specific commissions requested directly by the client (dedicated dimensions, themes, or techniques) are exempted from the right of return, pursuant to Art. 16, Letter c of GEO 34/2014.
7. Force Majeure
Neither party shall be held liable for the total or partial non-execution of its contractual obligations if such non-execution is caused by a force majeure event (natural calamities, states of emergency, restrictive governmental decisions, strikes, or global logistical blockades), as defined and recognized by Romanian law.
8. Legislation and Disputes
This document and the commercial relations arising from the use of the platform are governed exclusively by Romanian law. Any potential misunderstanding or conflict arising between the Cupola ProArte Association and buyers shall be settled with priority amicably. In the event that an amicable resolution is not possible, the dispute shall be submitted for resolution to the competent courts of law in Timișoara, Romania.
